Every real estate transaction, whether you are buying or selling property, involves a legal transaction. Many people have learned the hard way that you should always get things in writing. Our skilled real estate lawyers will draft all of your documents to ensure that you get what you pay for and that your legal rights are protected. We represent individuals and businesses regarding both residential and commercial property. I also provide representation in foreclosures, workouts, short sales and lien claims. This includes reviewing legal documents and providing contacts to lenders who may be able to assist with financing. They are not a lender and do not provide loans but they do provide your information to prospective lenders. The rates and terms will be based upon your credit. That same website has a mortgage calculator and has information on commonly used terms in the mortgage industry. If you prefer to work with local lenders I also have contact information for mortgage brokers or banks in the local metro area. As a result of the foreclosures and the poor real estate market there are a number of loan modification and short sale experts that may or may not be protecting you. I can review your documents and advise you of the benefits of the transaction, as well as the risks or exposure you may have in the transaction. A number of lenders do not want your real estate returned to them in a foreclosure or otherwise. In fact, at this time some lenders have determined not to proceed with any new foreclosures. We can assist you in working out an agreement to modify your loan which may include principal reductions, interest rate reductions or lengthening the term of your mortgage from a 30 to 40 year amortization period. Reducing your payment so that you can afford to keep your home will stabilize your situation and the lenders. If someone has filed a lien against your property, I can assist you in negotiating with the contractor or represent you in the lien foreclosure lawsuit. There are strict statutory time lines that must be followed in order for a lien to be validly placed against your property. I can advise you on those time lines and often times we can negotiate with the contractor to resolve the issue. Going through a divorce is one of the most difficult experiences you can go through in life. You should not go through it alone. Planning for the distribution of your assets after your death is an essential component of sound financial management. We also handle all probate court matters, including will contests and settlements of If you are overwhelmed with debt filing for relief either under Chapter 7 or Chapter 13 of the Bankruptcy Code may be the answer. A number of people need to file bankruptcy because of credit card debts, medical bills, or lawsuits. Some or all of these debts may be extinguished by filing the appropriate bankruptcy. You can stop harassing telephone calls from your creditors as well as certain lawsuits which are brought to collect on the debt. Depending on the circumstances you may be able to keep your home, automobile and certain personal property. A debtor is entitled to exempt certain property under either state or federal bankruptcy laws. The choice of exemptions chosen will depend on each individual circumstance. The Bankruptcy Code was revised in 2005 and a large number of people or corporations can still seek protection from their creditors either under Chapter 7 (commonly referred to as a liquidation bankruptcy). In this type of bankruptcy all of the non-exempt assets of the debtor are gathered together and sold by the bankruptcy trustee. In most cases these types of cases are referred to as no asset cases as the debtor has retained certain exempt assets and there are no assets available for the creditors. A Chapter 13 bankruptcy (payment plan) involves putting together a plan for repayment of all or a certain portion of the debts to the creditors. The debtor makes payments to a chapter 13 trustee who then divides the payments among the creditors of the debtor. For those seeking to reorganize their business or affairs a Chapter 11 Bankruptcy filing may be the answer. Chapter 11 Bankruptcy allows the debtor to extinguish certain contracts and allows the debtor to put together a plan to pay all or certain debts owed to its creditors. In some cases, I may negotiate with your creditors in order to provide you with an opportunity not to file for bankruptcy. Some creditors will prefer to get something from the debtor without the formality or formal legal proceedings of a bankruptcy.
